    Ordinance enactment procedure

    Ordinances refer to the laws of thelocal municipalities that can be enacted in relation to the rights and responsibilities of local residents within their autonomous rights without the need for authority delegated from the national laws. In other words, ordinances are the autonomous laws introduced by a local government according to its autonomous legislation authority, which are enacted by a vote of the local council within the scope of the law to govern the administrative work of the local government. The foundation for enacting ordinances can be found in Constitution of the Republic of Korea Article # 117 (1) that provides: “Local governments shall deal with administrative matters pertaining to the welfare of local residents, manage properties, and may enact provisions relating to local autonomy, within the limit of Acts and subordinate statutes.”

    • Submission / Proposal / Suggestion
      • To be submitted to the mayor of the district
      • To be proposed by the joint signature of at least one-fifth of the registered members of the council
      • To be submitted to the committees
    • Deliberation (Standing Committees)
    • Deliberation and determination/voting (plenary session)
      • Decision-making by a vote of more than half of the members present with the attendance of more than half of the registered members
    • Transfer
      • To be sent out to the mayor of the district within five days of the vote of the council
    • Promulgation
      • The mayor of the district promulgates the ordinances within 20 days (unless otherwise specified, the ordinances take effect from 20 days after the date of promulgation)
  • Budget proposal confirmation procedure

    Confirmation and Approval of Budget and Accounts

    Budget refers to the annual spending estimate of Gangdong-gu. The budget proposal is developed by the mayor of Gangdong-gu, which is then deliberated and confirmed by the Gangdong-gu Council, and the settlement of accounts, which shows how the budget was executed by the mayor, is approved by the council. The Gangdong-gu Councilhas budget proposals and accounts undergo a rigorous deliberation and decision-making process in order to ensure that not a penny of taxpayers’ money is wasted.

    • Developing and submitting a budget proposal (by the district mayor)
      • To be submitted by 40 days before the beginning of the fiscal year
    • Preliminary deliberation (Standing Committees), Comprehensive Deliberation (Special Committee on Budget and Accounts)
    • Deliberation and decision-making (plenary session)
      • To be completed by 10 days before the beginning of the fiscal year
    • Transfer/Confirmation
      • The chairman of the council sends the budget proposal passed by a vote to the mayor within three days
  • Account approval procedure

    Account approval procedure

    • Request for approval (the mayor)
      • The mayor shall complete the balance sheet within 80 days after the deadline for closing accounts
      • Attach the inspection report written by the account inspector selected by the local council, andrequest the district council’s approval of accounts
    • Preliminary deliberation (Standing Committees)
    • Comprehensive Deliberation (Special Committee on Budget and Accounts)
      • Confirm whether the budget was executed legally and appropriately based on the proposal approved by the council
    • Deliberation/Decision-making/Approval (Plenary session)
      • The approval of the settlement of accounts is subject to post-action control and should go through the final approval process of the local council
